İnsani İkamet Başvurusu Nereden Yapılır?

Başvurular, bizzat İl Göç İdaresi’nden yapılır. E-ikamet sisteminden başvuru yapılamamaktadır.

Kimler insani ikamet başvurusu yapabilir?

•Sınır dışı edilemeyen veya Türkiye’den ayrılması makul olmayanlar.

•Çocuğun yüksek yararının söz konusu olduğu durumlar.

•Tedavisi Türkiye dışında mümkün olmayan ağır sağlık sorunları.

•Diğer ikamet izinlerinin alınamadığı istisnai haller.

•Olağanüstü durumlarda verilen acil oturum izinleri.

•Uluslararası koruma başvurusu kabul edilen veya değerlendirilenler.

Belgeler, yeminli tercüman aracılığıyla Türkçe’ye çevrilmelidir. Her defasında 1 yıl için başvuru yapılabilir.

Yabancı hakkında tahdit kodunun bulunması, yabancının insani ikamet başvurusu yapmasına engel değildir.

İnsani İkamet İzni Başvurusunun Kabulü Halinde Ne Yapılmalıdır?

İzin verilen yabancı, veriliş tarihinden itibaren en geç yirmi iş günü içinde adres kayıt sistemine kayıt yaptırmak zorundadır.

İnsani İkamet Reddi Halinde Dava Açılabilir mi?

İnsani ikamet izni başvuruları, başvurunun gerekçesi ve belgelerin hazırlanması açısından hukuki değerlendirme gerektirir. Başvurunun reddedilmesi halinde idari dava açılması mümkündür. İdari dava açma süresi İnsani ikamet izni başvurusu ve dava süreci hakkında hukuki destek almak için bizimle iletişime geçebilirsiniz.

Application for Humanitarian Residency

Applications must be submitted in person at the Provincial Migration Directorate. Applications cannot be submitted through the e-Residence system.

Who is eligible to apply for humanitarian residence?

•Individuals who cannot be deported or whose departure from Turkey is not reasonable.

•Cases where the best interests of the child are at stake.

•Severe health issues that cannot be treated outside of Turkey.

•Exceptional cases where other residence permits cannot be obtained.

•Emergency residence permits issued in extraordinary circumstances.

•Individuals whose applications for international protection have been accepted or are under review.

Documents must be translated into Turkish by a certified translator. Applications may be submitted annually.

The presence of a restriction code regarding the foreign national does not prevent the foreign national from applying for a humanitarian residence permit.

What Should Be Done If the Humanitarian Residence Permit Application Is Approved?

The foreign national granted the permit must register with the address registration system within twenty business days from the date of issuance.

Can a Lawsuit Be Filed If the Humanitarian Residence Permit Is Denied?

Applications for a humanitarian residence permit require legal evaluation regarding the grounds for the application and the preparation of supporting documents. If the application is denied, it is possible to file an administrative lawsuit. The deadline for filing an administrative lawsuit, as well as legal advice regarding the humanitarian residence permit application and the litigation process, is provided by legal counsel.
